Simarjot Singh Judge, a leading legal expert, explains that if the row became a trademark suit, the core question is about “who holds the commercial rights to exploit the name, not about banning family members from using their surname.”
Trademark law is crystal clear – whoever is officially registered generally has the upper hand. Unless Brooklyn (or his legal team) can provide compelling evidence to challenge that registration, the current holder keeps control. “Family name legal battles often involve emotional and branding pitfalls and are a PR nightmare,” Judge highlights. And when your disputes play out in the tabloids, reputations can be damaged beyond repair.
If the fight gets that public, private family details could be dragged onto the court record – an outcome both sides would surely want to avoid.
The future: Will there even be a trial?
While media speculation runs wild about Brooklyn facing a “path of no return”, most legal experts think an all-out trial is actually unlikely. The costs, unpredictability, and emotional fallout are too high when family and brand are so tightly linked.
Judge believes the best solution would probably be a private renegotiation, or finding some workable middle ground for both parties to exploit the name commercially without direct conflict.
